A Petitioner may file for a divorce but may have second thoughts and desire to cancel the filing.
There are two ways this can be done.
The first way is to file a notice of discontinuance with liberty to apply. What this means is that you will have an opportunity to continue the same case at a later date. This is usually done when the parties want an opportunity to reconcile or for some other reasons best known to them.
The second way to dismiss the case that has already been filed is to do nothing. Once a case is filed and there is no activity in that case for about six months or more, the court may dismiss the case for lack of activity. If one of the parties wants to activate the case, that party would file a motion to relist the case in court.
