My spouse says I will never get custody of our children because I do not make enough money. Is that true?

The court takes into consideration several factors when awarding custody. Not having enough money or being unemployed is not one of them. The number one factor that the court looks to when making decisions involving children is what is in the best interest of the child.

While not having enough money may be a negative factor during your child custody case, you can still get custody of your child as long as the court determines that it is in the child best interest to stay with you.

Depending on the custody arrangement, you may be entitled to receive child support from the other parent in order to help you to take care of your child. It is the court’s position that both parents have an obligation to take care of the child.

Once the right to physical custody is granted to one spouse, the other spouse will be entitled to ask for the right of access.
When granting access, the court would take into consideration an arrangement based on the comment of the parent or in the absence of the comment make any such order as it think reasonable and for the benefit of the child concerned.
The amount of visiting periods, the timing and the duration of the visits must be such as will meet the desires of the parents and the child.
